Agreeing to these terms
By joining the Program, you agree to follow and be bound by these Terms of Use. If you do not agree, do not complete your purchase.
We may change these terms at any time by posting the new version on this page. Changes take effect when they are posted. The newest version is always at thedigitalmediateacher.com/terms, and using the Program after a change means you accept it.
Disclaimer
By joining the Program, you understand that Amanda Umberger is a licensed educator in the State of Washington.
The Program is for informational and educational purposes only. It does not replace the professional advice of an attorney, accountant, financial advisor or software representative.
We do our best to keep the Program's content accurate and up to date, but we do not promise that all of it is accurate or free of errors at all times, and we are not responsible for its accuracy, safety or effectiveness as it applies to you.
No warranties
The Program is offered "as is", without representations, guarantees or warranties of any kind, express or implied, including implied warranties of merchantability and fitness for a particular purpose, to the extent the law allows.
Assumption of risk
Use your best judgment when using the Program. You use it at your own risk, and you are responsible for your own actions and choices related to it.
We do not promise that the site will always be available, uninterrupted, secure or error-free, or free of viruses or other harmful components. You are responsible for any damage to your computer or loss of data that results from downloading materials from the site.
What the membership includes
Your membership gives you access to the member library, the monthly meetings and their recordings, and the member community for as long as your membership is active.
We may add, update or remove resources, meetings or features over time.
Your account
You must be 18 or older to buy a membership.
One membership is for one teacher. Do not share your password or login with anyone. If you share your login with someone who did not buy the Program, your membership will be ended immediately and no refund will be issued.
How you may use the resources
We give you a limited, personal, revocable, non-exclusive license to use the resources with your own students while your membership is active.
You may:
- Use the resources with your own students.
- Print or copy them for your own classes.
- Post them for your own students in a class site that needs a password, like Google Classroom or Canvas.
- Share them with a substitute teacher who is covering your class, for that coverage.
You may NOT:
- Share your login or the files with other teachers, including teachers at your own school.
- Post the files anywhere the public can find them.
- Sell, resell, give away or distribute the files, or upload them to another website or store.
- Use the resources, or anything made from them, in connection with any product, program or service you sell, without our written permission.
- Claim that the resources are your own work, or present them as your own product.
- Upload the resources into AI tools to copy, rewrite, recreate or resell them, or use them to train AI. Our AI Policy (thedigitalmediateacher.com/ai-policy) is part of these terms and explains what is allowed.
When you post your students' work or results from these resources on any website or social media, tag The Digital Media Teacher's social media accounts or link to thedigitalmediateacher.com.
A school or team that wants access for more than one teacher needs one membership per teacher.
Intellectual property
The Program and its content, including the curriculum, lessons, projects, activities, rubrics, slides, videos and other CTE materials, are the intellectual property of InkFire Creative LLC, doing business as The Digital Media Teacher, and are protected by copyright law. Your membership lets you use them. It does not make you the owner of them.
The names The Digital Media Teacher and The Digital Media Teacher's Club, and their logos, belong to InkFire Creative LLC. You may not use them in a way that suggests your product or service comes from us or is approved by us. Other product and company names on this site may be trademarks of their owners.
Misuse of our intellectual property, including selling, sharing or passing off our resources as someone else's product, may lead us to take legal action to recover damages and protect our rights, against you or anyone acting with you, to the fullest extent the law allows.
The member community and what you post
When you post anything in the member community, meetings chat or any other interactive area, you give us a permanent, royalty-free license to use, post, edit and share it in any form, and you give other members the right to view, download and use it for their own personal use. This includes posts, files and testimonials.
When you post a lesson or resource, you confirm that it is your own work.
You agree that you will not:
- Use the community for anything illegal.
- Post anything that violates someone else's copyright, trademark, privacy or other rights.
- Post anything false, harassing, abusive, threatening or embarrassing about another person.
- Post obscene, sexually explicit or violent material.
- Post advertising, sales pitches or business solicitations.
- Pretend to be someone you are not.
- Post material that is disruptive or off-topic.
We do not monitor every post and are not responsible for what members post. Opinions in the community are the members' own, and you rely on them at your own risk. You are responsible for what you post.
We may remove any post, or remove any member from the community, at any time and for any reason, and we may close the community at any time. You hold us harmless from any claims by others that arise from what you post or do in the community.
No claims about results
Testimonials and examples are just that, examples. They do not guarantee that you or your students will get the same results, and we do not promise any particular result at all.
Please check your district and school rules before using any of the ideas or resources in your classroom.
Payments and billing
When you pay by card, you authorize us to charge your card for the Program. Your payment details are collected by Kajabi and its payment processors, which have their own privacy and security policies. We are not responsible for their policies or practices.
Your membership renews on its own on the billing schedule of the plan you chose at checkout (for example monthly, every 3 months or yearly) until you cancel. If your plan starts with a trial, it renews on that plan's schedule when the trial ends, unless you cancel before then. You agree that we may charge your payment method on each renewal date without asking you again.
The price and how often you are billed are shown at checkout before you pay.
Failed payments
If a renewal payment does not go through, the card is tried again automatically over the following weeks, your membership is marked past due, and you get an email asking you to update your card. You keep your access while the card is being retried, and you can update your card on your billing page at any time.
If every attempt fails, your membership is cancelled and your access ends, with no refund for earlier periods. If you join again later, you join at the current price.
Your price
Your price stays the same for as long as your membership stays active.
If you cancel, or your membership ends because of a failed payment, and you join again later, you join at the current price. Any earlier special price or discount does not carry over.
We may change the price for new members at any time.
School purchases
A school can buy one year of access for one teacher with a P-Card, a purchase order or a check. A school purchase is paid once and does not renew on its own.
For a purchase order, the membership begins on the date we receive the purchase order and ends one year later. We will send a renewal invoice and reminder emails before it ends.
If we do not receive a new purchase order or payment by the end of the twelfth month, the membership ends. To come back, the school pays the current price, and any earlier discount does not carry over.
Email [email protected] for a purchase order or check.
How to cancel
You can cancel anytime. Log in, open your billing page and cancel there, or email us and we will do it for you.
When you cancel, you keep access until the end of the time you have already paid for, and you are not charged again. There are no partial or prorated refunds.
Refunds
Because the resources are digital and you can download them right away, payments are not refunded. If something went wrong with your order or your membership, email [email protected] and we will do everything we reasonably can to make it right.
No chargebacks
If you have a problem with a charge, email us first and we will work it out with you. You agree not to file or threaten a chargeback with your bank or card company for any charge related to the Program. If a chargeback is filed, we may end your membership.
Release and indemnity
To the fullest extent the law allows, you release InkFire Creative LLC, doing business as The Digital Media Teacher, and its owners, employees, contractors and affiliates from all claims related to your purchase or use of the Program, its materials or our website.
You agree to defend, indemnify and hold us harmless from any claims, damages, costs or liabilities that arise from your use of the Program or from your breaking these terms.
Limitation of liability
We are not liable for any damages you suffer, directly or indirectly, from using the Program, including from misuse of the Program or failure to use it properly.
In no event will we be liable to you for any indirect, special, exemplary or consequential damages. As far as the law allows, the most we can owe you for any claim is the amount you paid us in the 12 months before the claim.
Disputes and arbitration
If you have a complaint or an issue with the Program, email Amanda first at [email protected] and we will try to resolve it together.
If we cannot resolve it that way, you and InkFire Creative LLC, doing business as The Digital Media Teacher, agree to settle the dispute by binding arbitration with the American Arbitration Association (AAA), under its rules, before an arbitrator we both agree on. Any hearing will be held within 20 miles of Port Orchard, Washington.
By agreeing to this, you give up your right to a jury trial in court.
A judgment on the arbitrator's award may be entered in the courts of Kitsap County, Washington. The only award that can be made to you is a refund of what you paid for the Program. You may not seek other damages, including consequential or punitive damages.
The law that applies
These terms follow the laws of the State of Washington, USA. Any court action allowed under these terms, including to enforce an arbitration award or to protect our intellectual property, will be brought in Kitsap County, Washington.
When we may end a membership
We may end a membership that breaks these terms, for example by sharing a login, posting the files in public, or presenting the resources as your own product, with no refund.
Other terms
You may not scrape, crawl, data mine or send automated queries to the site, or use it to build a competing product, collect email addresses or send unsolicited messages.
This site is for adults. It is not intended for anyone under 18.
You agree to follow all laws that apply to your use of the site, and that the information you give us is true and accurate.
If you believe your work has been copied on this site in a way that infringes your copyright, email [email protected] with: your physical or electronic signature; a description of the work; where the material is on the site; your address, phone number and email; a statement that you believe in good faith the use is not authorized; and a statement, under penalty of perjury, that your notice is accurate and that you are the copyright owner or authorized to act for the owner.
If any part of these terms is found invalid or unenforceable, the rest of the terms still apply.
These terms are the entire agreement between you and us about the Program.
